Terms of Use

Welcome to MercuryPitch, an open-source vocal pitch-training app at mercurypitch.com (the “Service”). The core app is free; some optional features use paid credits (see Section 6). These Terms of Use (“Terms”) are a binding agreement between you and Irchiinnuss, the operator of MercuryPitch (“we,” “us”). Please read them.

1. Acceptance

By using the Service, you agree to these Terms and to our Privacy Notice. If you don’t agree, please don’t use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your country) to use the Service. If you’re under 18, use it only with a parent or guardian’s permission.

3. The Service is provided “as is”

The Service is provided “as is” and “as available,” with no warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of pitch detection or vocal separation, or uninterrupted availability. You use it at your own risk. The core app is free; certain optional features (such as faster server-side vocal separation) are paid and governed by Section 6.

4. Your responsibility for audio and other content

You are solely responsible for any audio, music, or other content you provide to the Service (your “Content”), including any track you use with the optional stem-separation (karaoke) feature.

You represent and warrant that, for every piece of Content you provide, you either own it or have all the rights, licenses, and permissions necessary to use it with the Service. Do not provide audio you don’t have the right to use. You are responsible for how you use any results, including any instrumental or vocal stems you create.

To provide a feature you request, you grant us a limited, non-exclusive, royalty-free license to use, store, and process your Content only as needed to deliver that feature to you, and for no other purpose. We do not claim ownership of your Content or of any results, and we do not use your Content to train or fine-tune any machine-learning models.

Vocal separation runs either on your device or, if you choose the faster paid option, on our processing servers. In both cases you provide the audio file — the Service does not download, “rip,” or fetch audio from YouTube, Spotify, Apple Music, or any other streaming or third-party service on your behalf. Where audio is processed on our servers, we keep it only as long as needed to return your result and then delete it (see our Privacy Notice).

5. Acceptable use

You agree not to use the Service to:

  • provide, process, or share content you don’t have the rights to, or to infringe anyone’s copyright or other rights;
  • do anything illegal, or to create content that is unlawful, harmful, harassing, or abusive;
  • rip, download, or pull audio from YouTube, Spotify, Apple Music, or any other streaming service or third-party source in violation of their terms, or by circumventing any technological protection measure — provide your own files instead;
  • disrupt, overload, scrape, or attack the Service or other users, or circumvent any technical limits;
  • misuse community features (see Section 8).

We may suspend or limit access if you break these rules.

6. Payments, credits, donations, and refunds

Everything that runs on your device is free. Faster, server-side vocal separation is optional and paid for with credits. Separately, you can donate to support the project’s development.

  • Credits. Credits are prepaid, priced at the amounts shown in the app at the time of purchase (plus any applicable taxes), and are spent when a server-side separation job is submitted. Credits have no cash value, are not transferable, and are redeemable only for the Service.
  • Payment processing. Payments are handled by our processor, Stripe. We do not receive or store your full card details, and your purchase or donation is also subject to the processor’s terms.
  • Donations. Donations are voluntary contributions towards running and developing MercuryPitch. A donation is not a purchase: you are not buying goods, services, or access, and no part of the Service is withheld from people who do not donate.
  • Supporter thank-yous. A donation may come with a supporter badge and similar extras for a stated period. These are a thank-you, not the thing you paid for. We may change, replace, or withdraw them at any time, and doing so is not a failure to deliver a purchase. Any support or prioritisation we mention is a good-faith intention, not a guaranteed service level.
  • Donations are non-refundable. Because a donation is a voluntary gift rather than a purchase, it is not refundable, except where the law requires otherwise or where the payment was clearly made in error — write to us and we will look at it.
  • No tax deduction. Irchiinnuss is a business, not a registered charity or non-profit. Donations are not tax-deductible and we do not issue charitable donation receipts.
  • Refunds. If a server-side job fails for a reason on our side, or you cancel it while it is still queued and before processing has started, the credits for that job are returned to your balance. Once a job has started or finished processing, the credits for it are used and non-refundable. We do not refund credits already spent, or a completed separation you changed your mind about.
  • Your statutory rights. Nothing here limits any non-waivable consumer or withdrawal rights you may have under the law of your country; where those apply, they prevail over this section.
  • Pricing changes. We may change prices or the contents of credit packs going forward; changes do not affect credits you have already bought.

7. Intellectual property

The MercuryPitch software is open source under the GNU AGPL-3.0 license; you’re free to use, study, modify, and self-host it under that license (see our repository). These Terms cover the hosted Service at mercurypitch.com and do not limit your rights under AGPL-3.0. Our name and logo remain ours. Your Content stays yours.

8. Community content

If you share melodies, scales, a display name, leaderboard scores, or join peer-to-peer “jam” sessions, you’re responsible for what you share and how you behave. Don’t post infringing, unlawful, or abusive content, and treat other users with respect. We may remove community content or revoke access for violations.

9. Privacy

How we handle data is described in our Privacy Notice. In short, live pitch detection runs on your device and your microphone audio stays in your browser.

10. Copyright complaints and takedowns

We respect intellectual-property rights and expect you to do the same. If you believe content made available through the Service infringes your copyright, send a notice to hello@mercurypitch.com that includes:

  • identification of the copyrighted work you claim has been infringed;
  • identification of the material you claim is infringing, and where it appears, in enough detail for us to locate it;
  • your name, address, and contact details;
  • a statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law;
  • a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf.

We will review valid notices and remove or disable access to the infringing material where appropriate. If your material was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the same address. We terminate the accounts of users who repeatedly infringe.

11. Limitation of liability and indemnity

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your Content or your use of the Service. Our total liability to you for any claim will not exceed the greater of (a) the total amount you paid us for the Service in the 12 months before the claim, or (b) USD 50.

You agree to defend and indemnify us against any third-party claim arising from your Content, your use of the Service, or your breach of these Terms.

12. Changes

We may update or change these Terms at any time. If we make material changes, we’ll update the date above and, where reasonable, give notice. Continued use of the Service means you accept the updated Terms.

13. Governing law and contact

These Terms are governed by the laws of Croatia, without regard to conflict-of-law rules, and the Croatian courts have jurisdiction over any dispute. If you are a consumer, this does not remove any mandatory consumer-protection rights, or the right to bring a claim in the courts, of your country of residence. Questions: hello@mercurypitch.com.
